For decades, photographs, video, and audio recordings have been treated as the gold standard of evidence. A captured moment – whether on film or in a single photograph – has traditionally carried an implicit presumption of truth, shaping courtroom decisions, news reporting, and public perception alike. The underlying assumption was simple: if it was recorded, it reflected reality. That assumption is now under the microscope.
Advances in Artificial Intelligence (AI) have made it possible to generate highly realistic synthetic media – commonly referred to as deepfakes – including images, video, and voice recordings. Tools built on technologies such as Generative Adversarial Networks (GANs) and diffusion models are no longer confined to specialists. They are widely accessible, inexpensive, and capable of producing convincing results with minimal technical expertise.
While these developments unlock significant creative and commercial opportunities, they also introduce a fundamental challenge: digital media can no longer be accepted at face value. For legal professionals in particular, this shift is critical. Evidence that was once considered inherently reliable must now be approached with the same level of scrutiny as witness testimony or documentary records. Understanding both the capabilities and the limitations of AI-generated content is becoming essential in disputes, investigations, and litigation.
In this final article of our three-part series discussing trust in the digital age, Ryan Shields explores the forensic implications of synthetic media and how investigators are adapting to an environment where visual evidence requires careful validation.
The challenge in determining authenticity
Detecting manipulated or synthetic media is not straightforward. Human perception is often ill-equipped to identify subtle inconsistencies in lighting, facial movement, or audio patterns – particularly as AI-generated outputs continue to improve. Even trained observers struggle to reliably distinguish authentic from synthetic media once a certain level of realism is achieved, reinforcing the need for technical validation beyond visual inspection alone.
To illustrate, consider a simple image manipulation exercise. A photograph of two known subjects in a meeting is disclosed during proceedings – a meeting which one party claims never occurred and which the other claims it did. A surveillance-style photograph is disclosed as depicted below (figure 1):

On the naked eye, there is no clear and obvious manipulation that has occurred.
Now consider Image B, below – the original image (figure 2).

In one version of the image, the facial appearance of the male subject has been replaced with the subject’s face, and the surrounding area is largely unaffected by the change. The setting of the image, the textures and lighting, and female facing away from the camera all continue to be portrayed with realism, despite the manipulation taking place on a free online tool. The edit takes only minutes and requires no specialist skills. In the absence of the original image, proving that Image A is unauthentic and has been tampered with can be a challenging exercise for investigators. In practical terms, this creates a scenario where the burden shifts from simply identifying manipulation to actively disproving an apparently plausible piece of evidence.
On close inspection, minor imperfections may still be visible. However, the exercise demonstrates an important point: even basic tools can alter the context of an image in a convincing way. With more advanced software and greater intent, the potential for realistic manipulation increases significantly. This is particularly relevant in contentious scenarios, where selectively altered media can be used to support a misleading narrative while retaining enough realism to avoid immediate scrutiny.
Compounding the issue, metadata, once a cornerstone of digital investigation, is also not consistently reliable. Key metadata can be stripped, modified, or lost through standard handling – re-encoding through social media uploads or sharing via third party messaging apps often leaves investigators with incomplete information. As a result, metadata should be treated as one component of the evidential picture rather than a definitive indicator of authenticity, particularly where the chain of custody is unclear.
Forensic approach in practice
Given these challenges, digital forensic analysis relies on a structured, multi-layered methodology designed to assess authenticity and provenance.
Contextual analysis is the starting point. Investigators gather all available background information: how and when the media was captured, the device used, how it has been stored or shared, and how it was disclosed. This establishes an initial assumption of what the media should look like if it is genuine. Discrepancies at this stage – such as timelines that do not align or inconsistencies in disclosure – can provide early indicators that further scrutiny is required.
Source attribution follows. This involves examining metadata and encoding characteristics and comparing them against reference libraries of known devices and software outputs. The goal is to determine whether the file’s structure is consistent with its claimed origin. In some cases, this can extend to identifying artefacts associated with specific editing tools or generative models, although such attribution is not always definitive.
Visual and technical validation is then conducted. Investigators assess whether the content aligns with known facts – examining environmental details such as lighting, shadows, reflections, and background elements. At a more granular level, analytical techniques can identify inconsistencies in compression patterns, pixel structures, or frame sequencing that may indicate manipulation.
In some cases, controlled testing is also performed. Investigators attempt to replicate potential scenarios (whether legitimate or manipulative) to understand how specific artefacts or anomalies might arise. This can be particularly valuable in distinguishing between artefacts introduced through benign processing and those indicative of deliberate alteration.
Importantly, this process does not typically produce absolute certainty. Instead, it results in a confidence-based assessment, enabling legal professionals to weigh the reliability of the evidence within the broader context of a case. In this sense, digital forensics is less about delivering definitive answers and more about reducing uncertainty to a level where informed decisions can be made.
Conclusion
The principle that “seeing is believing” is no longer sufficient in an era of synthetic media. While photographs and videos remain valuable forms of evidence, their reliability can no longer be assumed without question.
Digital forensics provides a disciplined framework for evaluating authenticity, combining contextual understanding with technical analysis. As the capabilities of AI continue to evolve, so too must the approaches used to assess digital evidence.
For legal and investigative professionals, the key shift is not to abandon trust in visual media, but to treat it with appropriate caution. This ensures that conclusions are grounded in rigorous, defensible analysis rather than assumption.
